This is the last will and testament of me Henry Carter of Stansfield, watch and clock maker.
First I give and devise unto my dear wife Ann Carter all that messuage or tenement now in my own occupation with the cottage adjoining with the yards, gardens and appurtenances to the same premises belonging. And also all those eight freehold cottages or tenements with the yards and gardens to the same premises respectively belonging which hereditaments I purchased of Daniel Creffield and Benjamin Martin. All which said premises are situate and being in Stansfield aforesaid. And also all those three copyhold cottages or tenements with the yards, gardens and appurtenances to the same respectively belonging situate and being in the parish Denston in the said county of Suffolk. And also all other my messuages or tenements and real estate whatsoever and wheresoever, to hold all the aforesaid hereditaments and premises unto my said wife Ann and her assigns for and during the term of her natural life, she keeping the same in good and tenantable repair and condition and insured against loss or damage by fire in some reputable insurance office in the sum of three hundred pounds to the intent that such sum or any part thereof which may become payable be laid out in rebuilding or repairing such part of the said premises as may be destroyed or damaged by fire.
And from and immediately after the decease of my said wife then I give and bequeath all that messuage or tenement wherein I now reside with the cottage or tenement adjoining with the yards, gardens and appurtenances to the same premises belonging unto my son Jaazaniah Carter, his heir and assigns forever.
I give and bequeath all those my three copyhold cottages or tenements with the yards, gardens and appurtenances thereto belonging situate and being in Brook Street Denston in the county of Suffolk (which said premises descended to me as heir at law of Henry Carter deceased) unto my son Samuel Carter his heirs and assigns forever.
And I give and bequeath all those eight freehold cottages or tenements with the yards, gardens and appurtenances to the same respectively belonging or appertaining situate and being in the parish of Stansfield aforesaid and which I purchased of Creffield and Martin unto my said sons Jaazaniah Carter and Samuel Carter their heirs and assigns. To hold all and singular the said hereditaments and premises unto and to the use of the said Jaazaniah Carter and Samuel Carter or the survivor of them or their heirs or assigns of such survivor do and shall as soon as conveniently may be after the decease of my said wife but within the space of twelve calendar months next after that event sell and absolutely dispose of the said hereditaments and premises by public auction or private contract and either together or in parcels as to them or him shall seem expedient for such price or prices or sum or sums of money as can reasonably be obtained for the same. And do and shall convey and assure the said hereditaments and premises unto the purchaser or purchasers thereof or otherwise as he or they shall direct. And I do hereby declare that the receipt or receipts of my executors for the time being of this my will shall be good and effectual discharge and discharges to any person or persons becoming the purchaser or purchasers their heirs, executors, administrators or assigns shall not afterwards be answerable or accountable for the loss misapplication or non application thereof, or be in anywise obliged or concerned to see to the application of or to the necessity of raising the money in such receipts acknowledged to be received or any part thereof. And as to the clear monies which shall arise from such sale or sales as aforesaid after payment of all expenses incident thereto and the rents and profits of the said hereditaments in the meantime accruing from the decease of my said wife until such sale or sales I give and bequeath the same in manner following (that is to say)
One equal fourth part thereof unto my daughter Susannah Carter, one other equal fourth part thereof unto my daughter Emily Carter, one other equal fourth part thereof unto my daughter Hannah now the wife of Frederick Downs. And the remaining fourth part thereof I give and bequeath the same unto the children of my deceased daughter Mary, late the wife of John Sarjent, equally to be divided between them share and share alike as and when they shall respectively attain their respective ages of twenty one years with all accumulations thereof.
And I give and bequeath all my household furniture and implements of household beds and bedding unto my said wife Ann for her to have the use occupation and enjoyment thereof during her life. And from and immediately after her decease I direct that the same furniture and implements of household beds and bedding shall be sold and the monies which shall arise from the sale thereof I give the same in manner following.
(Vedelicit) One equal sixth part thereof unto my son Jaazaniah Carter, one other sixth part thereof unto my son Samuel Carter, one other sixth part thereof unto my daughter Susannah Carter, one other sixth part thereof unto my daughter Emily Carter, one other sixth part thereof unto my daughter Hannah the wife of Frederick Downs, and the remaining sixth part thereof unto and equally among the children of my deceased daughter Mary, late the wife of John Sarjent, in equal shares and proportions.
And I do hereby will, order and direct that the legacies, shares and bequests hereinbefore given to such of my legatees as are or shall be females shall be paid and payable into the hands of them my female legatees only and on their respective receipts alone, and, that such legacies shall not be subject to the debts, control or engagements of any present or future husband.
And I hereby give and bequeath all my working tools and implements used in my business unto my sons Jaazaniah Carter and Samuel Carter to be equally divided between them immediately after my decease.
And I hereby nominate, constitute and appoint my said sons Jaazaniah Carter and Samuel Carter executors of this my will and I direct that they pay all my just debts and funeral expenses and the charges or proving or in anyway relating to the performance of this my will out of my personal estate as soon as conveniently may be after my decease. And I do hereby declare that it shall and may be lawful for my said executors to reimburse himself and themselves respectively all such loss, costs, charges and expenses as he or they may sustain or be put to for travelling expenses, loss of time or howsoever otherwise in the execution of this my will or in anywise relating thereto. And lastly I do hereby revoke and make void all former and other wills by me at any time heretofore made and declare this only to be my last will and testament.
In witness whereof I the said Henry Carter (the testator) have to this my last will and testament contained in three sheets of paper set my hand to the first two sheets thereof and my hand and seal to this the third and last sheet thereof this twentieth day of March in the year of our Lord on thousand eight hundred and forty eight.
Signed, sealed, published and declared by the said Henry Carter (the testator) as and for his last will and testament in the presence of us who at his request and being together in his presence have subscribed our hands as witnesses to the same Henry Carter
